Legal regulation of investments and investment protection

The legislative instrument regulating the relations arising from investment activity on the territory of the Republic of Belarus is the Investment Code of the Republic of Belarus.

According to the Investment Code of the Republic of Belarus there are two forms of investment activity:

  1. creation of a legal entity;
  2. acquisition of property or property rights, namely :
    • share in the charter fund of a legal entity, including cases of increasing the charter fund of a legal entity;
    • real estate;
    • securities;
    • rights to intellectual property;
    • concessions;
    • equipment;
    • other fixed assets.

Investment sources may include:

  • own funds of investors , including sinking funds, profit remaining after payment of taxes and other obligatory payments, including funds received from the sale of shares in the charter fund of a legal entity;
  • borrowed and obtained funds , including loans from banks and non-bank credit and financial institutions, loans of founders (participants) and other legal entities and individuals, bonded loans.
